Terms of using Ogmo.

Plain-language summary

Before the legal text: here is what this document actually means.

  • Ogmo requires an active internet connection for captioning. Your audio is sent to a third-party speech recognition API for real-time captioning and speaker identification. Transcript text is sent to a third-party AI service to generate session summaries. Your transcripts are saved locally on your device — not on our servers.
  • Captions and summaries are AI-generated. Accuracy varies based on audio conditions, accents, and environment. For situations where a transcription error would have serious consequences, use supplementary support alongside the App.
  • The app is provided as-is. We cannot guarantee it will work perfectly in every environment.
  • You own your transcripts. We do not store them.
  • All payments are processed by Apple through the App Store. For billing issues, refunds, or payment disputes, contact Apple directly.
  • If something goes wrong outside of payment matters, our liability is limited to the greater of what Apple remitted to us on your behalf in the last 12 months, or $10 USD.
  • Apple distributes this App but is not a party to these Terms. Apple has no obligation to provide support, maintenance, or warranty for the App — that responsibility is ours.

1. Who you are agreeing with

These Terms and Conditions (“Terms”) are a legal agreement between you (“User”) and Ogmo (“we”, “us”, “our”), a project currently operated by Daria Iaparova (founder and operator) and Wentao Guo (Apple Developer account holder), pre-incorporation, trading as Ogmo. References to “Ogmo” refer to this team and any future incorporated entity operating under the Ogmo brand.

Note on incorporation: Upon incorporation, these Terms will be updated to reflect the registered legal entity name, jurisdiction, and company number.

By downloading, installing, or using the Ogmo iOS application (“App”), you agree to these Terms. If you do not agree, do not use the App.

2. What Ogmo is

Ogmo is an iOS application designed to provide real-time captions, speaker identification, and AI-generated session summaries for Deaf and Hard-of-Hearing (DHH) university students and others who benefit from accessible audio transcription.

The App is an assistive technology tool. It is not a certified medical device, an official accessibility compliance solution, or a replacement for professional captioning services or sign language interpreters.

3. Who can use Ogmo

You may use Ogmo if:

  • You are at least 13 years of age (or the minimum age in your jurisdiction for entering agreements)
  • You have downloaded the App through the Apple App Store
  • You agree to these Terms and Apple's App Store Terms of Service

If you are under 18, you should review these Terms with a parent or guardian.

Ogmo is available globally through the Apple App Store, with current focus on university students in ASEAN and English-speaking regions. Nothing in these Terms limits who may use the App based on disability status — the App is built for everyone who benefits from real-time captions.

4. License to use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on any Apple-branded device that you own or control, for your personal, non-commercial use, subject to these Terms and Apple's App Store Terms of Service.

You may not:

  • Sublicense, sell, resell, transfer, assign, or otherwise dispose of your rights to the App
  • Use the App on any device you do not own or have the legal right to use
  • Use the App for any purpose other than as described in these Terms

These Terms do not transfer any ownership of the App to you. The App is licensed, not sold.

5. Subscription and payment

5.1 Pricing and plans

Ogmo offers a free usage tier and paid subscription plans that provide additional captioning hours per month. One-time top-up add-ons are also available for users who need additional hours without a subscription.

Current pricing for all tiers, subscriptions, and top-ups is set by Ogmo and displayed in the App Store at the time of purchase. Ogmo may change pricing and plan structures at its discretion. For material changes to active paid subscriptions, we will provide reasonable advance notice.

5.2 How billing works

All purchases are processed exclusively by Apple through the App Store. Ogmo is not a payment processor. Ogmo does not collect, store, handle, or have access to your payment information, billing details, or financial data.

Subscription state management and entitlement tracking is handled by RevenueCat on our behalf. Subscription hours are allocated monthly and do not roll over.

5.3 Refunds and billing disputes

All refunds, billing disputes, and payment-related issues are governed by Apple's refund policy and must be directed to Apple. To request a refund, use Apple's standard App Store refund process at reportaproblem.apple.com.

6. How your data is handled

6.1 How processing works

The App requires an active internet connection to function. When you use real-time captioning, your audio is transmitted to Soniox for speech-to-text conversion. Transcript text is transmitted to Google Gemini to generate session summaries. Analytics and crash reports are collected via Google Firebase.

6.2 What we store — and what we do not

Your transcripts and session summaries are saved locally on your device only. Ogmo does not store your transcripts or audio on our own servers.

We do not collect:

  • Your audio recordings (beyond transmission for real-time processing)
  • Stored copies of your transcripts or session summaries on our servers
  • Biometric data of any kind
  • Your name, email, or identity (unless you contact us directly)

6.3 – 6.5

If you contact us for support, we may retain that communication. Transcripts are saved locally on your device — you are solely responsible for backing them up. A full Privacy Policy is incorporated into these Terms by reference.

7. Accuracy and limitations

Ogmo uses Soniox for real-time speech-to-text and speaker identification. Caption accuracy depends on microphone quality, background noise, speaker accents, internet connection, and language.

We do not guarantee that captions, speaker identifications, or session summaries will be accurate, complete, or suitable for any particular purpose.

Do not rely on Ogmo captions for anything where an error could have serious consequences — for example, medical appointments, legal proceedings, or formal academic examinations without supplementary support in place.

Using Ogmo does not guarantee that a university, institution, or individual meets any legal accessibility or disability accommodation obligation.

8. Your responsibilities

As a user, you agree to:

  • Use the App lawfully and in compliance with these Terms
  • Not record individuals without their knowledge or consent where required by law
  • Not use the App to capture, store, or distribute content in violation of privacy or recording laws
  • Not attempt to reverse-engineer, decompile, or extract the App's source code
  • Not distribute, sublicense, or resell the App or its output for commercial purposes without written permission
  • Not use the App in any way that could damage or interfere with associated systems

9. Intellectual property

The Ogmo application, including its code, design, and branding, is owned by Ogmo and protected by applicable intellectual property laws.

You retain full ownership of any transcripts, summaries, or other content generated by the App based on your sessions. We claim no rights over your content.

10. Third-party services

The App integrates with the following third-party services. Your use is subject to their respective terms and privacy policies:

  • Sonioxreal-time speech-to-text and speaker identification. Privacy policy

11. Maintenance and support

Ogmo, not Apple, is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services for the App.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law:

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We expressly disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

Apple provides no warranty for this App. In the event of failure to conform to any applicable warranty, you may notify Apple and Apple will refund your App purchase price (if any). Apple has no other warranty obligation with respect to the App.

Some jurisdictions do not allow the exclusion of implied warranties. If you are in such a jurisdiction, some of these exclusions may not apply to you.

13. Product claims

Ogmo, not Apple, is responsible for addressing any claims you or any third party may have relating to the App, including product liability, regulatory compliance, consumer protection, privacy, and intellectual property claims. Apple has no responsibility for investigating, defending, settling, or discharging any such claims.

14. Legal compliance and export

By using the App, you represent that you are not located in a country subject to an embargo or designated as a “terrorist supporting” country, and are not listed on any government list of prohibited or restricted parties. You will comply with all applicable local, national, and international laws.

15. Limitation of liability

To the maximum extent permitted by applicable law:

Ogmo will not be liable for indirect, incidental, special, consequential, or punitive damages; loss of data or transcripts; damages from reliance on inaccurate captions; or unavailability of third-party services.

Our total liability will not exceed the greater of: (a) the amount Apple has remitted to Ogmo attributable to your purchases in the 12 months preceding the claim, or (b) $10 USD.

Payment-related matters are explicitly excluded from Ogmo's liability. All billing and payment disputes are controlled exclusively by Apple through reportaproblem.apple.com.

Some jurisdictions do not allow certain liability limitations. Nothing in these Terms limits liability that cannot be excluded by law.

16. Apple as third-party beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

17. Termination

You may stop using the App at any time by deleting it from your device. Deleting the App will permanently remove all locally stored transcripts and session data.

We reserve the right to suspend or terminate your access at any time if you violate these Terms. In cases of serious violations, termination may be immediate and without notice.

On termination, your license to use the App ends. Sections that by their nature should survive termination will survive.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date and, for material changes, notify you within the App or by other reasonable means.

Continued use of the App after updated Terms take effect constitutes your acceptance. If you do not agree, stop using the App.

19. Governing law and disputes

These Terms are governed by the laws of Australia, without regard to conflict of law principles. Disputes will first be attempted to be resolved informally by contacting support@ogmo.app. If informal resolution fails within 30 days, disputes will be subject to the exclusive jurisdiction of the courts of Australia.

Consumer protection rights: Nothing in these Terms limits, waives, or overrides any rights you may have under applicable mandatory consumer protection law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

21. Entire agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Ogmo regarding the App, and supersede all prior agreements and understandings.
